Mistakes Made When Seeking A Divorce

May 2, 2017 By Henry Williams Leave a Comment

Seeking a divorce is something that nobody wants, but unfortunately and sadly it does occur. And should it happen, nobody wishes to make any errors. So, let’s take a look at some mistakes that people make during divorce proceedings:

Commonplace mistakes when seeking a divorce will include either one or both parties failing to consult a legal expert, concealment or dispersion of assets, and sadly the use of children as pawns in such proceedings. Should somebody not completely understand either their legal rights or how their behaviour can affect the divorce, they may just end up with a less than pleasing financial and custody settlement. In a worst-case scenario, anyone who makes common divorce mistakes can definitely end up having to cope with criminal charges and alienation from their children.

Not a Delightful Experience and Stressful

Obtaining a divorce has been in many cases always an extremely stressful occurrence, and it is understandable that many people would like to postpone dealing with the hard issues of divorce, such as asset division, and who will receive essential responsibility for any children. A divorce is a legal proceeding needing expert legal advice from divorce lawyers in London, that’s for sure.

For example, a couple may have agreed to divide their assets or prepare child custody in a way that might not be favourable to one party, due to one or both parties simply being ignorant of the law. Whilst many lawyerswill encourage divorcing couples to work out a mutually agreeable settlement, the lawyers may suggest that their clients don’t go through with this until they can go over the client’s financial situation. After a verbal agreement has been decided upon, it can be very troublesome for a spouse to backtrack and demand their fair share later on.

Concealment

Another common error in getting a divorce and one that can create problems for spouses’ years later, after a divorce is complete, is that of concealing assets or debts. Lawyers need to acquire a full picture of a couple’s financial situation so they can advise their clients as to how the division of assets should be managed. Unfortunately, some spouses may lead separate financial lives and have some extra cash or investments put aside or have inherited massive debts. By not disclosing such during a divorce,it can be considered fraud and may result in criminal charges for the dishonest spouse or an expensive legal battle and divorce settlement.

More Errors

And then there are some spouses who make the mistake of going into a new romantic partnership during divorce proceedings. This can certainly create friction between the divorcing couple, especially if the spouse introduces the new partner to their children. Courts can take a grim view of such a situation, and the upset spouse may even become vindictive, making the process of getting a divorce take a lot longer than it would have.

It’s in your very best interests to seek out experts in the legal field. An experienced and professional team will guide you all the way and with the best results.
